text-decoration: none">학교폭력</a>대책이 가해자에 대한 처벌 강화에서 선도하는 방향으로 바뀐다.<br /><br />교육부 고위 관계자는 16일 "그동안 학교폭력 대책이 가해학생을 지나치게 엄격하게 처벌하는 등 징계 위주로 이뤄지고 있다는 지적을 받았다"며 "가해학생에게 학교폭력 우범지역에 대한 단속권을 줘 학교폭력을 줄이는 방안을 검토중"이라고 말했다.<br /><br />교육부는 우선 학교폭력 문제를 근본적으로 해결하기위해서는 학생들 스스로 주인의식을 갖고 학교폭력을 예방하고 해결하는 분위기를 마련하는 것이 중요하다고 보고 학생들 스스로 우범지역을 순찰하도록 할 예정이다.<br /><br />일명 '일진'들에게 단속권을 부여해 완장을 달고 화장실, 학교 인근 등 우범지역을 순찰하도록 한다는 계획이다.<br /><br />이렇게 하면 책임의식을 갖게 돼 일진들이 앞장서서 규범을 지키게 되는 등 학내에 솔선수범 하는 분위기가 조성 된다는 것이다.<br /><br />교육부 관계자는 "현재는 학교폭력 발생 위험도가 높은 학교를 일진 경보학교로 지정해 특별관리 하거나 가해자를 강제전학 시키는 등 처벌 위주의 성격이 강하다"며 "하지만 이는 아이들을 바른길로 인도해야 하는 교육의 본질적인 목적과 부합되지 않는다"고 말했다.<br /><br />실제로 교육부의 '학교폭력 조치상황'에 따르면 지난해 1학기 동안 학교폭력대책자치위원회의가 가해학생에게 내린 조치 가운데 '외부기관 연계 선도'나 '교육환경 변화 조치' 등 강력한 조치가 전체의 42.9%에 달했다.<br /><br />유형별로는 사회봉사 8.5%, 특별교육 또는 심리치료 9.7%, 출석정지 17.2%, 전학 7.5%, 퇴학 0.7% 등이다.<br /><br />이는 비교적 가벼운 조치인 교내 선도 유형에 속하는 조치사항인 서면사과와 학교내봉사(32.7%) 보다도 더 높은 수치다.<br /><br />부가유형 조치로 피해학생 및 신고·고발 학생에 대한 접촉·협박 및 보복행위 금지는 9.6%, 학급교체는 14.6%였다. 교내 선도와 부가유형 조치는 졸업 후 삭제되는 반면 외부기관 연계 선도와 교육환경 변화 조치는 졸업 후 5년 동안 학생부에 기록이 남는다.<br /><br />하지만 이같은 가해자에 대한 처벌 강화는 실효성이 없고 부작용만 야기하고 있다는 지적이 수차례 제기됐다.<br /><br />특히 '강제 전학' 조치의 경우 전학을 간 가해학생이 해당 학교에서 또 학교폭력을 저지르거나 예전 학교를 찾아가 보복폭행을 하는 경우가 종종 발생했기 때문이다.<br /><br />현장 교사들 역시 정부의 학교폭력 대책이 지나치게 처벌위주라며 가해 학생들과 피해 학생을 분리하고 가해학생을 엄격히 처벌하기 보다는 이들의 행동이 변화할 수 있도록 분위기를 조성해야 한다고 주장해 왔다.<br /><br />교육부는 최근 진행한 '온라인 국민 정책제안'을 통해 이런 아이디어를 얻었다. 한 초등학생이 "학생들이 스스로 학교 근처나 화장실 등 사각지대를 자율적으로 순찰해 학교를 스스로 지킬 수 있도록 하자"는 제안을 한 것이다.<br /><br />하지만 교육계는 일진들에게 단속권을 부여하는 것이 자칫하면 이들에게 무소불위의 권한을 주는 꼴이 돼 학교폭력을 더 심화시킬 수 있다며 우려하고 있다.<br /><br />교육부 관계자는 이와 관련 "현장 실사를 나가보니 일진에게 단속권을 주면 학교폭력이 더 판을 친다는 우려와는 달리 학교폭력이 오히려 줄어들은 것으로 나타났다"며 "가해학생에게 지위를 부여해 책임의식을 갖도록 해 학생 스스로가 학교폭력은 좋지 않다는 인식을 가질 수 있는 기회를 줘야 한다"고 말했다.<br /><br />교육부는 이 같은 내용을 포함한 '현장중심 학교폭력 대책'을 다음달 중 발표한다는 방침이다.<br /><br />[email protected]<br /><br /><저작권자ⓒ 공감언론 뉴시스통신사. 무단전재-재배포 금지.><br /><br /></div> <div style="margin: 0px;
